Supreme Court Rules in EEOC’s favor in EEOC v. Abercrombie & Fitch

The U.S. Supreme Court released its much-anticipated decision in EEOC v. Abercrombie & Fitch today. The case deals with religious accommodations in the workplace. In the case, an applicant was denied employment at Abercrombie & Fitch because her headscarf violated the company’s “Look Policy.” The Supreme Court rejected the company’s lack of “actual knowledge” argument, and instead ruled that the company’s motive in denying the applicant employment, regardless of its actual knowledge, was the dispositive issue in the case.

In so holding, the Court noted that “an employer who acts with the motive of avoiding accommodation may violate Title VII even if he has no more than an unsubstantiated suspicion that accommodation would be needed.” Full opinion here
